HP Race Development operates this website and online store, including all related information, content, features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced herein, govern your access to and use of the Services and your purchase of any products from HP Race Development.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. You may not transfer or assign your account.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to display product information accurately; however, images, descriptions, specifications, and colors may vary based on device, settings, and manufacturing tolerances.

All product descriptions, specifications, pricing, and availability are subject to change at any time without notice. We reserve the right to discontinue any product or limit quantities at our discretion.

SECTION 2A – PERFORMANCE & MOTORSPORTS PRODUCTS; ASSUMPTION OF RISK

Many products sold by HP Race Development are high-performance, motorsports, racing, competition, or off-road products. Such products involve inherent risks, including mechanical failure, engine damage, property damage, personal injury, or death.

By purchasing, installing, or using any product from HP Race Development, you expressly acknowledge and agree that:

  • You assume all risks associated with installation, tuning, calibration, operation, and use.

  • You are solely responsible for selecting the correct product and confirming compatibility.

  • Improper installation, tuning, fueling, ignition, or operation can cause serious damage or injury.

  • HP Race Development is not responsible for how products are installed, tuned, or used.

SECTION 2B – INSTALLATION, TUNING & LEGAL COMPLIANCE

Unless explicitly stated in writing, HP Race Development does not provide installation, tuning, or calibration services as part of any product sale.

You are solely responsible for:

  • Proper installation and setup

  • Verifying air/fuel ratios, ignition timing, temperatures, and safe operating limits

  • Ongoing maintenance and inspection

  • Ensuring vehicle and component integrity

Some products may be intended for closed-course competition or off-road use only and may not be legal for street use. You are solely responsible for compliance with all local, state, federal, and international laws, including emissions, noise, and vehicle regulations.

SECTION 3 – ORDERS

By placing an order, you are making an offer to purchase. HP Race Development reserves the right to accept or reject any order for any reason.

Orders may begin processing immediately. Cancellations or changes are not guaranteed once an order is placed. Any approved cancellation is subject to our published Return & Refund Policy, including applicable restocking or processing fees.

Returns and refunds are governed solely by our Return & Refund Policy.

SECTION 4 – PRICES & BILLING

All prices are subject to change without notice. Prices do not include taxes, shipping, duties, or fees unless stated otherwise.

You represent that you are authorized to use the payment method provided and that all billing information is accurate. You agree to pay all charges incurred.

SECTION 5 – SHIPPING & DELIVERY

All delivery dates are estimates only. HP Race Development is not responsible for carrier delays or events beyond our control.

Title and risk of loss pass to you once the product is delivered to the carrier.

SECTION 6 – INTELLECTUAL PROPERTY

All content on the Services is owned by or licensed to HP Race Development and is protected by intellectual property laws. No rights are granted except as expressly stated.

SECTION 7 – OPTIONAL TOOLS

Third-party tools are provided “as is” without warranties. Use is at your own risk. We are not responsible for third-party tools or services.

SECTION 8 – THIRD-PARTY LINKS

We are not responsible for third-party websites or products. Accessing third-party links is at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

HP Race Development is powered by Shopify. Shopify is not responsible for any aspect of sales between you and HP Race Development. You expressly release Shopify from all claims arising from purchases made through the Services.

SECTION 10 – PRIVACY POLICY

Your personal information is governed by our Privacy Policy and Shopify’s Privacy Policy.

SECTION 11 – FEEDBACK

Any feedback you provide may be used by HP Race Development without restriction or compensation.

SECTION 12 – ERRORS & OMISSIONS

We reserve the right to correct errors and cancel orders arising from inaccuracies at any time.

SECTION 13 – PROHIBITED USES

You agree not to misuse the Services or violate any laws or rights.

SECTION 14 – TERMINATION

We may terminate access at any time. All obligations incurred prior to termination remain enforceable.

SECTION 15 – DISCLAIMER OF WARRANTIES

ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS, WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.

HP RACE DEVELOPMENT DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION:

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • PERFORMANCE RESULTS

  • DURABILITY

  • NON-INFRINGEMENT

We do not guarantee horsepower gains, reliability, drivability, emissions compliance, or engine longevity. Any performance examples or dyno results are illustrative only and not guarantees.

SECTION 16 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, HP RACE DEVELOPMENT SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

  • Engine or vehicle damage

  • Mechanical failure

  • Loss of use, downtime, or lost profits

  • Personal injury or death

  • Towing, labor, or repair costs

  • Third-party installation or tuning errors

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT AT ISSUE.

SECTION 16A – NO LIABILITY FOR LABOR OR CONSEQUENTIAL COSTS

Under no circumstances will HP Race Development reimburse labor, diagnostic time, installation costs, tuning costs, shop fees, transportation, or any third-party expenses.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless HP Race Development, Shopify, and their affiliates from any claims, damages, losses, or expenses arising from:

  • Installation, tuning, or use of products

  • Mechanical failure

  • Injury or death

  • Legal or regulatory violations

SECTION 18 – SEVERABILITY

If any provision is unenforceable, the remainder remains in full force.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and HP Race Development.

SECTION 20 – ASSIGNMENT

You may not assign these Terms. We may assign freely.

SECTION 21 – GOVERNING LAW

These Terms are governed by the laws of the state in which HP Race Development is headquartered, without regard to conflict of law principles.

SECTION 22 – HEADINGS

Headings are for convenience only.

SECTION 23 – CHANGES TO TERMS

We may update these Terms at any time. Continued use constitutes acceptance.
